Welcome to WaterSports and Marine. By accessing our website, purchasing our products, or utilizing our services, you agree to comply with and be bound by the following Terms of Service.

1. Product Display & Accuracy

  • Marine Application: We make every effort to display product specifications, dimensions, and compatibility accurately. However, boat specifications vary wildly. It is ultimately the buyer's responsibility to verify that a part fits their specific vessel make, model, and year before installation.

  • Pricing Errors: We reserve the right to cancel orders or refuse service if a product is inadvertently listed at an incorrect price.



2. Orders, Titles, & Vessel Purchases

  • Vessel Sales: The purchase of any boat, trailer, or major outboard motor is governed by a separate, binding Vessel Purchase Agreement. The terms of that specific agreement will supersede these general online Terms of Service.

  • Title Transfer: Ownership and risk of loss for major assets pass to the buyer only upon full payment clearance and execution of the state-required title documentation.



3. Service, Repairs, & Winterisation
If you are booking mechanical service, detailing, or winterisation with our shop:

  • Authorization: You authorize our technicians to operate your vessel on the water or tow your trailer for testing and inspection purposes.

  • Storage Fees: Vessels left on our property for more than 7 days after service completion notifications will incur a storage fee of R300 per day.

  • Debris & Belongings: We are not responsible for personal items, electronics, or fishing gear left on the vessel while it is in our service yard.



4. Limitation of Liability
To the maximum extent permitted by law, WaterSports and Marine shall not be liable for any indirect, incidental, or consequential damages resulting from the use or installation of products purchased from us. This includes, but is not limited to, vessel damage, towing fees, lost time on the water, or improper installation by third parties.

5. Governing Law
These terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
